Do I need a permit to build a deck on Long Island?

Almost always, yes. On Long Island a deck attached to a house is a structure, and structures need a building permit from the town or village you live in, not from the county and not from the state.

Who actually issues the permit?

Your town or village building department does, and its rules are the ones that count.

Long Island is not one jurisdiction. Nassau and Suffolk are counties, but permits are issued by the town, and inside a town an incorporated village often runs its own building department with its own rules. Two houses a mile apart can sit under different requirements.

That is why a neighbour saying they did not need a permit tells you nothing useful about your own address. The only answer that counts is the one from the department that covers your property.

When can a deck skip the permit?

Some departments exempt a low, freestanding platform under a certain size and height, but the threshold is theirs to set and it varies.

The common pattern is that a small ground level platform, not attached to the house and low enough that no guard rail is required, falls outside the permit requirement. Raise it, attach it to the house, add stairs or a roof, and it stops being exempt.

Treat any exemption as something to confirm in writing rather than assume. A deck built on the assumption is the one that causes trouble later.
